Senate Examines Possible COPPA Updates

While the FTC has announced a hearing on June 2 to examine updating child privacy laws online, the Senate Commerce Committee yesterday held a hearing on the subject as well. Senate Commerce Chairman Jay Rockefeller said Thursday that he believes Congress may need to look at how mobile technology has made it necessary to update the law to protect kids who are accessing the Internet from their mobile devices. Rockefeller said “the whole world has changed” since the Children’s Online Privacy Protection Act(COPPA) was passed in 1998. The committee heard testimony from several companies, most notably Facebook and Microsoft (member of the Safe Internet Alliance).

COPPA required that web sites directed at children should do things like obtain parental consent before collecting personal information from those under 13. The FTC is now collecting comments on whether it should apply the rule to new technologies such as mobile devices, interactive television and interactive gaming.

Microsoft Associate General Counsel Mike Hintze urged the committee to let the FTC update the law as necessary.

"We don't believe legislative amendments are needed at this time," he said, adding that the FTC has appropriate flexibility to update the COPPA rule to reflect technological changes.

Does the FTC give 800 numbers for people to speak their opinions on internet safety for youth? As a father I would definitely like to voice my opinion about mobile technology safety. I have been putting off letting my 13 year old daughter have a cell phone because I am worried about her safety. I want to make sure that text marketing is appropriately monitored and internet marketing is properly monitored. When she does finally get a cell phone I will not allow her to have a data package for fear that she can find trouble on the internet.
